Terms of Service — Statalog

1. Agreement to Terms

By accessing and using Statalog ("the Service"), provided by Host Server SRL ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Statalog for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modifying or copying the materials
Using the materials for any commercial purpose or for any public display (commercial or non-commercial)
Attempting to decompile or reverse engineer any software contained on Statalog
Removing any copyright or other proprietary notations from the materials
Transferring the materials to another person or "mirroring" the materials on any other server
Scraping, crawling, or using automated tools to access the Service

3. Account Registration

3.1 Registration Requirements

To use Statalog, you must:

Provide accurate, current, and complete information
Maintain the confidentiality of your password
Accept responsibility for all activity under your account
Notify us immediately of any unauthorized use of your account

3.2 Account Termination

We reserve the right to terminate your account at any time for:

Violation of these Terms of Service
Abusive behavior or harassment
Illegal activity or content
Excessive resource consumption affecting the Service
Non-payment of invoices (for paid accounts)

We will make reasonable effort to notify you before termination, except in cases of severe violation or legal requirement.

4. Service Tiers & Pricing

4.1 Free Tier

The free tier includes:

Up to 5,000 tracked pageviews per month
Access to core analytics features
No credit card required

We reserve the right to suspend free accounts that exceed usage limits.

4.2 Paid Tiers

Paid subscriptions are billed monthly based on your monthly pageview volume. Pricing is displayed during sign-up and on your account page.

Billing occurs on the date of sign-up each month
Invoices are sent to your registered email
Payment is processed through Stripe

4.3 Price Changes

We may change our pricing with 30 days' notice. Changes take effect on your next billing date. Continued use of the Service constitutes acceptance of new pricing.

5. Billing & Payment

5.1 Automatic Renewal

Paid subscriptions automatically renew each billing cycle unless canceled. You can cancel anytime from your account settings.

5.2 Payment Method

You authorize us to charge the payment method on file for all fees and charges. Payment failures may result in account suspension.

5.3 Refund Policy

Refunds are available only for your first payment, within 15 days of sign-up. No refunds are available for subsequent billing cycles. To request a refund, contact us at support@statalog.com.

6. Data Ownership & Intellectual Property

6.1 Your Data

You retain all ownership rights to your analytics data. Statalog is a data processor only.

You may export your data at any time
You may delete your account and all associated data (subject to retention requirements)
We do not claim ownership of your data
We do not sell or share your data with third parties

6.2 Our Intellectual Property

All materials on Statalog (software, design, documentation, logos) are the property of Host Server SRL and protected by copyright. The cloud Service is proprietary. The open-source version is licensed under AGPL-3.0.

You may not:

Claim ownership of our intellectual property
Remove copyright or attribution notices
Use our trademarks without written permission

7. Acceptable Use Policy

You agree not to use Statalog to:

Scrape or Crawl: Use automated tools to extract data from the Service
Abuse Resources: Excessive requests that disrupt the Service for other users
Illegal Activity: Violate any applicable law or regulation
Harassment: Harass, threaten, or abuse Company staff or other users
Malicious Activity: Inject malware, viruses, or malicious code
Circumvent Security: Bypass authentication, rate limits, or access controls
Impersonation: Pose as another person or entity
Misleading Content: Submit false or misleading analytics data

Violation of this policy may result in immediate account suspension without refund.

8. REST API Terms

8.1 API Access

API access is provided to authenticated users. API keys can be managed from your account settings.

8.2 Rate Limits

The API is subject to rate limiting to ensure fair use. Excessive requests may be throttled or blocked.

8.3 API License

API access is for your own use only. You may not:

Resell or redistribute API access
Build competing services with the API
Share API keys with unauthorized parties

9. Limitation of Liability

DISCLAIMER: Statalog is provided "as-is" without warranties of any kind, express or implied.

9.1 No Warranties

We do not warrant that:

The Service will be error-free or uninterrupted
Defects will be corrected
The Service is free from viruses or malicious code

9.2 No Service Level Agreement (SLA)

Statalog does not provide an uptime guarantee or SLA. While we strive for reliability, the Service may experience downtime for maintenance, updates, or unforeseen issues without liability.

9.3 Limitation of Damages

In no event shall Host Server SRL, its officers, directors, employees, agents, or suppliers be liable for any damages (including lost profits, data loss, or business interruption) arising from:

Use or inability to use the Service
Unauthorized access to or alteration of your data
Third-party content or services
Any matter beyond our reasonable control

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Host Server SRL from any claims, damages, or costs (including legal fees) arising from your violation of these Terms, your use of the Service, or your infringement of third-party rights.

11. Termination & Survival

11.1 Termination

Either party may terminate the service agreement by:

For free accounts: No notice required, effective immediately upon deletion
For paid accounts: You may cancel from account settings; cancellation is effective at the end of the current billing cycle

11.2 Upon Termination

Upon account termination or deletion:

Your access to the Service is immediately revoked
You have 30 days to export your data
After 30 days, analytics data is permanently deleted
Billing records are retained for 7 years (legal requirement)

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Romania, without regard to its conflicts of law principles.

12.2 Arbitration

Any dispute arising from or relating to these Terms shall be resolved through binding arbitration administered by a mutually agreed-upon arbitrator, rather than in court (except for injunctive relief).

12.3 Contact for Disputes

Before initiating arbitration, please contact us at support@statalog.com to attempt resolution. Both parties agree to negotiate in good faith for 30 days before pursuing formal proceedings.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted with an updated "Last updated" date. Continued use of Statalog after changes constitutes acceptance of the updated Terms.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Host Server SRL regarding the Service and supersede all prior agreements, understandings, and negotiations.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
